NOTICE OF PUBLIC HEARING

 

 

Notice is hereby given that on Tuesday, July 25, 2006 at the hour of 5:15PM in City Hall Commission Chambers, 215 E. Center Street, Tucumcari, New Mexico, the Tucumcari Planning & Zoning Commission will hear public comments opposing to or in support of: Annexation of Contiguous Territory to the City of Tucumcari, New Mexico. 

 

A 36.08 acre tract of land being a portion of the southeast ¼ of the southwest ¼ and the south ½ of the southwest ¼ (lot 4) of Section 19, Township 11 North, Range 31 East, NMPM as described in that certain Warranty Deed recoded in Volume 78, Page 9 of the Deed Records of Quay County, New Mexico and said 36.08 acre tract of land being further described by metes and bounds as follows:

 

Beginning at the most westerly southwest corner of this tract of land, from whence the southwest corner of said Section 19 bears S. 00° 14’ 25” W., bearings contained herein are relative to true north as determined by GPS observation, 1241.25 feet from previous surveys; thence N. 00° 14’ 25” E., 80.73 feet along the west line of said Section 19, to the northwest corner of said Lot 4 and the southwest corner of Lot 3 of said Section 19; thence N. 88°53’ 57” E., at 60.00 feet pass a 5/8 inch iron rod with a cap stamped “PLS 3789”, found, a total distance of 2712.25 feet to a 5/8 inch iron rod with a cap stamped “PLS 3789”, found at the northeast corner of this tract of land and the northeast corner of the southeast ¼ of the southwest ¼ of said Section 19; thence S. 00° 12’ 35” W., 19.64 feet along the east line of said southeast ¼ of the southwest ¼ of said Section 19, to a ½ inch iron rod with a cap stamped “PLS NM 13841”, set at the most easterly southeast corner of this tract of land, from whence a railroad iron, found bears N. 60° 27’ 21” E., 194.27 feet; thence S., 60° 27’ 21” W., at 822.47 feet pass a railroad iron, found, a total distance of 843.47 feet along the northerly right-of-way line of Interstate Highway No. 40 as dedicated in that certain instrument recorded in Volume 98, Page 702 of the Deed Records of Quay County, New Mexico, to a ½ inch iron rod with a cap stamped “PLS NM 13841”, set at a jog corner of this tract of land; thence N. 47° 10’ 25” E., 261.04 feet to a ½ inch iron rod with a cap stamped “PLS NM 13841” set at a jog corner of this tract of land; thence S. 60° 27’ 25” W., 1604.63 feet along the north right-of-way line of interstate Highway No. 40 as dedicated in that certain instrument recorded in volume 98, Page 704 of the Deed Records of Quay County, New Mexico, to a ½ inch iron rod with a cap stamped “PLS NM 13841”, set at a point on a curve to the right with a radius of 2195.86 feet; thence Southwesterly, along said north line of Interstate Highway No. 40 and along said curve to the right, as arc distance of 239.75 feet and a chord of S. 77° 02’ 54” W., 239.63 feet to a ½ inch iron rod with a cap stamped “PLS NM 13841”, set at the beginning of a curve to the right with a radius of 1049.92 feet; thence westerly, along said north right-of-way line of Interstate Highway No. 40 and along said curve to the right, an arc distance of 183.84 feet and a chord of S. 85° 13’ 41” W., 183.61 feet to a railroad iron, found at the end of this curve; thence N. 89° 45’ 21” W., 160.29 feet along the north right-of-way line of said Interstate Highway No. 40 to a railroad iron, found at the most southerly southwest corner of this tract of land; thence N. 46° 21’ 24” W., 122.16 feet to a railroad iron, found at the most westerly southwest corner of this tract of land; thence N. 05° 36’ 31” W., 120.06 feet along the east right-of-way line of Mountain Road as dedicated by that certain instrument recorded in Volume 101, Page 97 of the Deed Records of Quay County, New Mexico, to a ½ inch iron rod with a cap stamped “PLS 13841” set in the west line of this tract of land; thence N. 00°23’ 46” E., 380.65 feet along the said east right-of-way line of Mountain Road, to a New Mexico Department of Transportation brass cap, found; thence N. 05°14’ 01” W., 100.39 feet along the said east right-of-way line of Mountain Road, to a ½ inch iron rod with a cap stamped “PLS NM 13841”, set at a jog corner of this tract of land and the southwest corner of a 3.00 acre tract of land described in that certain Warranty Deed recorded in Volume 113, Page 278 of the Deed Records of Quay County, New Mexico; thence S. 89° 45’ 53” E., 421.24 feet to a ½ inch iron rod with a cap stamped “PLS NM 13841”, set at a jog corner of this tract of land and the southeast corner of said 3.00 acre tract of land; thence N. 00° 14’ 07” E., 300.00 feet to a ½ inch iron rod with a cap stamped “PLS NM 13841”, set at a jog corner of this tract of land and the northeast corner of said 3.00 acre tract of land; thence N. 89° 45’ 53” W., at 411.67 feet pass a New Mexico Department of Transportation brass cap, found, and at 449.96 feet pass a ½ inch iron rod, found at the northwest corner of said 3.00 acre tract of land, a total distance of 512.67 feet to the point of beginning.

 

The annexation is being considered under provisions of 3-7-1 of the New Mexico State Statutes (NMSA 1978) and Zoning Ordinance 917. Being that the applicant has filed a valid application with the office of the Zoning Administration, City of Tucumcari, New Mexico 88401. All written responses including petitions received on or before 5:00 PM, July 24, 2006 will be read and considered at the hearing, written responses received or presented after this time will not be considered.
