City Commission Meeting

March 1, 2005

 

 

The Tucumcari City Commission met for a special meeting on Tuesday, March 1, 2005 at 3:30 p.m.  Members present constituting a quorum was Antonio Apodaca, James Witcher and Christopher Maestas.

 

City staff present at the meeting was Richard Primrose and Rachel Hicklin.

 

Bids & Contracts

 

Mayor Pro-tem Apodaca called on City Manager Primrose to present the Golf Professional/Course Consultant Services Contract.

 

City Manager Primrose presented the contract and advised that the annual contract fee would be Thirty-eight Thousand Five Hundred Dollars per year for a contract term of four years with two, two year extensions.

 

Commissioner Maestas questioned if the contract amount was the same as the previous contract.

 

City Manager advised that this contract was less than the previous contract.  He added that although it was not part of the contract, Mr. Tucker has agreed to give out two scholarships in the amount of Five Hundred Dollars each one for a female and one for a male.  In addition, he has agreed to extend the practice facilities and professional instruction at no charge during the school year for the golf team.

 

Mayor Pro-tem Apodaca questioned if the contract was only for the period through the end of this fiscal year.  He then questioned if anyone had done an inventory.

 

City Manager Primrose advised that this contract is a four year contract with two, two year extensions.  He went on to say that Charlie Maciel had done an inventory of the items that he owns at the golf course as he was negotiating with Mr. Tucker to buy his inventory.

 

Commissioner Maestas questioned if this contract could be terminated with ninety days notice.

 

City Manager Primrose advised that this was not in the previous contract and is also not included in this contract as the Golf Pro is required to maintain a certain amount of inventory, and if we have that type of clause in the contract, it would be hard to have someone put up the inventory required to operate the pro shop.

 

Commissioner Witcher advised that termination of the contract is addressed under the section breach of contract.

 

A motion for approval of the Golf Professional and Course Consultant Services Contract with Howie Tucker in the amount of Thirty-eight Thousand Five Hundred Dollars per year was made by Commissioner Witcher and seconded by Commissioner Maestas.  Roll call:
